Texto do artigo · p. 7 (3) The Offices of the countries of the Special Union shall include in the official documents for the deposit or registra- tion of designs, and, if they are officially published, in the publications in question, the numbers of the classes and sub- classes of the international classification into which the goods incorporating the designs belong. (4) In selecting terms for inclusion in the alphabetical list of goods, the Committee of Experts shall exercise reasonable care to avoid using terms in which exclusive rights may exist. The inclusion of any word in the alphabetical index, however, is not an expression of opinion of the Committee of Experts on whether or not it is subject to exclusive rights. Article 3 Committee of Experts (1) A Committee of Experts shall be entrusted with the tasks referred to in Article 1(4), (5) and 1(6). Each country of the Special Union shall be represented on the Committee of Experts, which shall be organized according to rules of procedure adopted by a simple majority of the countries rep- resented. (2) The Committee of Experts shall adopt the alphabetical list and explanatory notes by a simple majority of the votes of the countries of the Special Union. (3) Proposals for amendments or additions to the inter- national classification may be made by the Office of any coun- try of the Special Union or by the International Bureau. Any proposal emanating from an office shall be communicated by that Office to the International Bureau. Proposals from Of- fices and from the International Bureau shall be transmitted by the latter to the members of the Committee of Experts not later than two months before the session of the Committee at which the said proposals are to be considered. (4) The decisions of the Committee of Experts concerning the adoption of amendments and additions to be made in the

(2) (a) Subject to the provisions of Article 3, the As- sembly shall: (i) deal with all matters concerning the maintenance and development of the Special Union and the implementa- tion of this Agreement; (ii) give directions to the International Bureau concern- ing the preparation for conferences of revision; (iii) review and approve the reports and activities of the Director General of the Organization (hereinafter desig- nated as " the Director General ") concerning the Special Union, and give him all necessary instructions concern- ing matters within the competence of the Special Union; (iv) determine the program and adopt the biennial budget of the Special Union, and approve its final accounts; (v) adopt the financial regulations of the Special Union; (vi) decide on the establishment of official texts of the inter- national classification in languages other than English and French; (vii) establish, in addition to the Committee of Experts set up under Article 3, such other committees of experts and working groups as' it deems appropriate to achieve the objectives of the Special Union; (viii) determine which countries not members of the Special Union and which intergovernmental and international non-governmental organisations shall be admitted to its meetings as observers; (ix) adopt amendments to Articles 5 to 8; (x) take any other appropriate action designed to further the objectives of the Special Union; (xi) perform such other functions as are appropriate under this Agreement.

Texto do artigo · p. 10 (b) With respect to matters which are of interest also to other Unions administered by the Organization, the Assembly shall make its decisions after having heard the advice of the Coordination Committee of the Organization. (3) (a) Each country member of the Assembly shall have one vote. (b) One-half of the countries members of the Assembly shall constitute a quorum. (c) Notwithstanding the provisions of subparagraph (b), if, in any session, the number of countries represented is less than one-half but equal to or more than one-third of the countries members of the Assembly, the Assembly may make decisions but, with the exception of decisions concerning its own procedure, all such decisions shall take effect only if the conditions set forth hereinafter are fulfilled. The International Bureau shall communicate the said decisions to the countries members of the Assembly which were not represented and shall invite them to express in writing their vote or abstention within a period of three months from the date of the communication. If, at the expiration of this period, the number of countries having thus expressed their vote or abstention attains the number of countries which was lacking for attaining the quorum in the session itself, such decisions shall take effect provided that at the same time the required majority still obtains. (d) Subject to the provisions of Article 8(2), the decisions of the Assembly shall require two-thirds of the votes cast. (e) Abstentions shall not be considered as votes. (f) A delegate may represent, and vote in the name of, one country only. (4) (a) The Assembly shall meet once in every second calendar year in ordinary session upon convocation by the Director General and, in the absence of exceptional circumstances, during the same period and at the same place as the General Assembly of the Organization.

(c) The agenda of each session shall be prepared by the Director General. (5) The Assembly shall adopt its own rules of procedure. Article 6 International Bureau (1) (a) Administrative tasks concerning the Special Union shall be performed by the International Bureau. (b) In particular, the International Bureau shall prepare the meetings and provide the secretariat of the Assembly, the Committee of Experts, and such other committees of experts and working groups, as may have been established by the Assembly or the Committee of Experts. (c) The Director General shall be the chief executive of the Special Union and shall represent the Special Union. (2) The Director General and any staff member designated by him shall participate, without the right to vote, in all meet- ings of the Assembly, the Committee of Experts, and such other committees of experts or working groups as may have been established by the Assembly or the Committee of Experts. The Director General, or a staff member designated by him, shall be ex officio secretary of those bodies. (3) (a) The International Bureau shall, in accordance with the directions of the Assembly, make the preparations for the conferences of revision of the provisions of the Agreement other than Articles 5 to 8. (b) The International Bureau may consult with inter- governmental and international non-governmental organiza- tions concerning preparations for conferences of revision. (c) The Director General and persons designated by him shall take part, without the right to vote, in the discussions at those conferences.

(2) Adotam uma única classificação para os desenhos industriais (doravante designada "classificação internacional"). (3) A classificação internacional inclui: (i) uma lista de classes e subclasses; (ii) uma lista alfabética dos produtos em que os desenhos industriais estão incorporados, com indicação das classes e subclasses em que se enquadram; (iii) notas explicativas. (4) A lista de classes e subclasses é a lista anexada ao presente Acordo, sujeita às alterações e aditamentos que a Comissão de Peritos criada nos termos do artigo 3.º (a seguir designada "Comissão de Peritos") possa lhe introduzir. (5) A lista alfabética de produtos e as notas explicativas serão adotadas pela Comissão de Peritos, de acordo com o procedimento previsto no artigo 3.º. (6) A classificação internacional pode ser alterada ou complementada pela Comissão de Peritos, de acordo com o procedimento previsto no artigo 3.º. (7) (a) A classificação internacional será criada nas línguas inglesa e francesa.

Em particular, a classificação internacional não vincula os países da União Particular no que diz respeito à natureza e ao âmbito da protecção concedida ao desenho ou modelo nesses países. (2) Cada país da União Particular reserva-se o direito de utilizar a classificação internacional como sistema principal ou subsidiário. (3) Os Institutos dos países da União Particular incluirão nos documentos oficiais para o depósito ou registo de desenhos ou modelos e, se forem oficialmente publicados, nas publicações em questão, os números das classes e subclasses da classificação internacional a que pertencem os produtos que incorporam os desenhos ou modelos. Texto do artigo · p. 30 (1) À Comissão de Peritos serão confiadas as tarefas referidas nos n.ºs 4, 5 e 6 do artigo 1.º. Cada país da União Particular será representado na Comissão de Peritos, que será organizada de acordo com o regulamento interno adoptado por maioria simples dos países representados. (2) A Comissão de Peritos aprovará a lista alfabética e as notas explicativas por maioria simples dos votos dos países da União Particular. (3) As propostas de alterações ou aditamentos à classificação internacional podem ser apresentadas pelo Instituto de qualquer país da União Particular ou pelo Secretariado Internacional. Qualquer proposta proveniente de um Instituto deve ser comunicada por esse Instituto ao Secretariado Internacional. As propostas dos Institutos e do Secretariado Internacional serão transmitidas por este último aos membros da Comissão de Peritos, o mais tardar dois meses antes da sessão do Comité em que as referidas propostas serão analisadas. (4) As decisões da Comissão de Peritos relativas à adopção de alterações e aditamentos a introduzir na classificação internacional serão tomadas por maioria simples dos países da União Particular. No entanto, se tais decisões implicarem a criação de uma nova classe ou qualquer transferência de produtos de uma classe para outra, será necessária a unanimidade.

(6) Se um país não nomear um representante para uma determinada sessão da Comissão de Peritos, ou se o perito nomeado não tiver expressado o seu voto durante a sessão ou dentro de um prazo a ser prescrito pelo regulamento interno da Comissão de Peritos, considerar-se-á que o país em causa aceitou a decisão do Comité.

As decisões da Comissão de Peritos entrarão em vigor assim que a comunicação for recebida. Os anúncios das alterações e aditamentos serão publicados nos periódicos a serem designados pela Assembleia.

Texto do artigo · p. 31 (1) (a) A União Particular terá uma Assembleia composta pelos países da União Particular. (b) O Governo de cada país da União Particular será representado por um delegado, que poderá ser assistido por delegados suplentes, assessores e especialistas. (c) As despesas de cada delegação serão suportadas pelo Governo que a tiver nomeado. (2) (a) Sem prejuízo do disposto no artigo 3.º, a Assembleia poderá:
Texto do artigo · p. 31 (i) tratar de todos os assuntos relativos à manutenção e desenvolvimento da União Particular e à implementação do presente Acordo; (ii) dar orientações ao Secretariado Internacional sobre a preparação das conferências de revisão; (iii) rever e aprovar os relatórios e actividades do Director-Geral da Organização (doravante designado como “o Director-Geral”) relativos à União Particular e dar-lhe todas as instruções necessárias sobre assuntos da competência da União Particular; (iv) decidir o programa e adoptar o orçamento bienal da União Particular, bem como aprovar as suas contas finais;
Texto do artigo · p. 32 (v) adoptar os regulamentos financeiros da União Particular; (vi) decidir sobre a elaboração de textos oficiais da classificação internacional em línguas diferentes do inglês e do francês; (vii) criar, além da Comissão de Peritos instituído nos termos do artigo 3.º, outras comissões de peritos e grupos de trabalho que considere adequados para alcançar os objectivos da União Particular; (viii) decidir que países não membros da União Particular e que organizações intergovernamentais e internacionais não governamentais serão admitidos nas suas reuniões como observadores; (ix) adoptar alterações aos artigos 5.º a 8.º; (x) tomar quaisquer outras medidas adequadas destinadas a promover os objectivos da União Particular; (xi) desempenhar outras funções que sejam apropriadas nos termos do presente Acordo.
Texto do artigo · p. 32 (b) No que diz respeito a assuntos que também sejam do interesse de outras Uniões administradas pela Organização, a Assembleia tomará as suas decisões após ouvir o parecer da Comissão de Coordenação da Organização.
Texto do artigo · p. 32 (3) (a) Cada país membro da Assembleia terá direito a um voto. (b) Metade dos países membros da Assembleia constituirá quórum. (c) Não obstante o disposto na alínea b), se, em qualquer sessão, o número de países representados for inferior a metade, mas igual ou superior a um terço dos países membros da Assembleia, esta poderá tomar decisões, mas, com excepção das decisões relativas ao seu próprio procedimento, todas essas decisões só produzirão efeitos se forem cumpridas as condições a seguir estabelecidas. O Secretariado Internacional comunicará as referidas decisões aos países membros da Assembleia que não estiveram representados e convidá-los-á a expressar por escrito o seu voto ou abstenção no prazo de três meses a contar da data da comunicação. Se, no termo desse prazo, o número de países que assim expressaram o seu voto ou abstenção atingir o número de países que faltava para atingir o quórum na própria sessão, essas decisões entrarão em vigor, desde que, ao mesmo tempo, a maioria exigida ainda seja obtida. (d) Sem prejuízo do disposto no n.º 2 do artigo 8.º, as decisões da Assembleia exigirão dois terços dos votos expressos. (e) As abstenções não serão consideradas votos. (f) Um delegado só pode representar e votar em nome de um único país. (4) A Assembleia reunir-se-á uma vez a cada dois anos civis em sessão ordinária, mediante convocação do Director-Geral e, salvo circunstâncias excepcionais, durante o mesmo período e no mesmo local da Assembleia Geral da Organização. (b) A Assembleia reunir-se-á em sessão extraordinária mediante convocação do Director-Geral, a pedido de um quarto dos países membros da Assembleia. (c) A ordem do dia de cada sessão será preparada pelo Director-Geral. (5) A Assembleia adoptará o seu próprio regulamento interno.
Número ou marcador · p. 33 Artigo 6.º Secretariado Internacional (1) (a) As tarefas administrativas relativas à União Particular serão executadas pelo Secretariado Internacional. (b) Em particular, o Secretariado Internacional preparará as reuniões e assegurará o secretariado da Assembleia, da Comissão de Peritos e de quaisquer outras comissões de peritos e grupos de trabalho que possam ter sido criados pela Assembleia ou pela Comissão de Peritos. (c) O Director-Geral será o chefe executivo da União Particular e representará a União Particular. (2) O Director-Geral e qualquer membro do pessoal por ele designado participarão, sem direito a voto, em todas as reuniões da Assembleia, da Comissão de Peritos e de quaisquer outras comissões de peritos ou grupos de trabalho que possam ter sido criados pela Assembleia ou pela Comissão de Peritos. O Director-Geral, ou um membro do pessoal por ele designado, será secretário ex officio desses órgãos. (3) (a) O Secretariado Internacional, de acordo com as orientações da Assembleia, fará os preparativos para as conferências de revisão das disposições do Acordo, com excepção dos artigos 5.º a 8.º. (b) O Secretariado Internacional poderá consultar organizações intergovernamentais e internacionais não governamentais sobre os preparativos para as conferências de revisão. (c) O Director-Geral e as pessoas por ele designadas participarão, sem direito a voto, nas discussões dessas conferências. (4) O Secretariado Internacional desempenhará quaisquer outras tarefas que lhe forem atribuídas.

Texto do artigo · p. 33 (1) (a) A União Especial terá um orçamento. (b) O orçamento da União Especial incluirá as receitas e despesas próprias da União Especial, a sua contribuição para o orçamento das despesas comuns às Uniões e, quando aplicável, o montante disponibilizado para o orçamento da Conferência da Organização. (c) As despesas que não sejam imputáveis exclusivamente à União Especial, mas também a uma ou mais outras Uniões administradas pela Organização, serão consideradas despesas comuns às Uniões. A participação da União Especial nessas despesas comuns será proporcional ao interesse que a União Especial tiver nelas. (2) O orçamento da União Especial será fixado tendo em devida consideração as necessidades de coordenação com os orçamentos das outras Uniões administradas pela Organização. (3) O orçamento da União Especial será financiado pelas seguintes fontes:

Texto do artigo · p. 34 (4) (a) Para efeitos de determinação da sua contribuição referida no n.º 3, alínea i), cada país da União Especial pertencerá à mesma classe a que pertence na União de Paris para a Proteção da Propriedade Industrial e pagará as suas contribuições anuais com base no mesmo número de unidades fixado para essa classe nessa União. (b) A contribuição anual de cada país da União Especial será um montante proporcional ao total a ser contribuído para o orçamento da União Especial por todos os países, de acordo com a relação entre o número de unidades de cada país e o total de unidades de todos os países contribuintes. (c) As contribuições serão exigíveis no primeiro dia de janeiro de cada ano. (d) Um país que esteja em atraso no pagamento das suas contribuições não poderá exercer o seu direito de voto em qualquer órgão da União Especial se o montante dos seus atrasados for igual ou superior ao montante das contribuições devidas pelos dois anos completos anteriores. No entanto, qualquer órgão da União Especial pode permitir que tal país continue a exercer o seu direito de voto no referido órgão se, e enquanto, estiver convencido de que o atraso no pagamento se deve a circunstâncias excecionais e inevitáveis. (e) Se o orçamento não for aprovado antes do início de um novo exercício financeiro, será mantido ao mesmo nível do orçamento do ano anterior, conforme previsto nos regulamentos financeiros. (5) O valor das taxas e encargos devidos pelos serviços prestados pelo Secretariado Internacional em relação à União Especial será fixado e comunicado à Assembleia pelo Director-Geral. (6) (a) A União Especial será dotada de um fundo de capital de giro constituído por um pagamento único feito por cada país da União Especial. Se o fundo se tornar insuficiente, a Assembleia decidirá sobre o seu aumento. (b) O montante do pagamento inicial de cada país para o referido fundo ou da sua participação no aumento do mesmo será proporcional à contribuição do país para o ano em que o fundo for constituído ou em que for tomada a decisão de o aumentar. (c) A proporção e as condições de pagamento serão fixadas pela Assembleia, sob proposta do Director-Geral e após apreciação do parecer do Comité de Coordenação da Organização. (7) (a) No acordo de sede celebrado com o país em cujo território a Organização tem a sua sede, deve ser previsto que, sempre que o fundo de capital de giro seja insuficiente, esse país concederá adiantamentos. O montante desses adiantamentos e as condições em que são concedidos serão objecto de acordos separados, em cada caso, entre o referido país e a Organização. (b) O país referido na alínea (a) e a Organização terão, cada um, o direito de denunciar a obrigação de conceder adiantamentos, mediante notificação por escrito. A denúncia produzirá efeitos três anos após o final do ano em que tiver sido notificada. (8) A auditoria das contas será efetuada por um ou mais países da União Especial ou por auditores externos, conforme previsto no regulamento financeiro. Os auditores serão designados pela Assembleia, mediante o seu consentimento.
Número ou marcador · p. 35 Artigo 8.º Alteração dos artigos 5.º a 8.º
Texto do artigo · p. 35 (1) As propostas de alteração dos artigos 5.º, 6.º, 7.º e do presente artigo podem ser apresentadas por qualquer país da União Especial ou pelo Director-Geral. Tais propostas devem ser comunicadas pelo Director-Geral aos países da União Especial com pelo menos seis meses de antecedência em relação à sua apreciação pela Assembleia. (2) As alterações aos artigos referidos no parágrafo (1) serão adotadas pela Assembleia. A adopção exigirá três quartos dos votos expressos, desde que qualquer alteração ao artigo 5.º e ao presente parágrafo requeira quatro quintos dos votos expressos. (3) Qualquer alteração aos artigos referidos no n.º 1 entrará em vigor um mês após o Director-Geral ter recebido notificações escritas de aceitação, feitas em conformidade com os respetivos processos constitucionais, de três quartos dos países membros da União Especial no momento em que a alteração foi adotada. Qualquer alteração aos referidos artigos assim aceite vinculará todos os países que sejam membros da União Especial no momento em que a alteração entrar em vigor, ou que se tornem membros da mesma numa data posterior, desde que qualquer alteração que aumente as obrigações financeiras dos países da União Especial vincule apenas os países que tenham notificado a sua aceitação de tal alteração.

Texto do artigo · p. 35 (1) Qualquer país signatário da Convenção de Paris para a Proteção da Propriedade Industrial que tenha assinado o presente Acordo pode ratificá-lo e, caso não o tenha assinado, pode aderir ao mesmo. (2) Os instrumentos de ratificação e adesão serão depositados junto do Director-Geral. (3) (a) No que diz respeito aos primeiros cinco países que tiverem depositado os seus instrumentos de ratificação ou adesão, o presente Acordo entrará em vigor três meses após o depósito do quinto instrumento. (b) No que diz respeito a qualquer outro país, o presente Acordo entrará em vigor três meses após a data em que a sua ratificação ou adesão tiver sido notificada pelo DirectorGeral, salvo se tiver sido indicada uma data posterior no instrumento de ratificação ou adesão. Neste último caso, o presente Acordo entrará em vigor em relação a tal país na data indicada. (4) A ratificação ou adesão implicará automaticamente a aceitação de todas as cláusulas e a admissão a todas as vantagens do presente Acordo.

Texto do artigo · p. 36 (1) Qualquer país pode denunciar o presente Acordo mediante notificação dirigida ao Director-Geral. Tal denúncia afetará apenas o país que a efetuar, permanecendo o Acordo em pleno vigor e efeito no que diz respeito aos outros países da União Especial. (2) A denúncia produzirá efeitos um ano após a data em que o Director-Geral tiver recebido a notificação. (3) O direito de denúncia previsto no presente Artigo não poderá ser exercido por nenhum país antes do termo de um prazo de cinco anos, a contar da data em que se tornou membro da União Especial.

Número ou marcador · p. 37 Artigo 14.º Assinatura, Línguas, Notificações (1) (a) O presente Acordo será assinado em um único exemplar nas línguas Inglesa e Francesa, sendo ambos os textos igualmente autênticos, e será depositado junto do Governo da Suíça. (b) O presente Acordo permanecerá aberto para assinatura em Berna até 30 de junho de 1969. (2) Os textos oficiais serão determinados pelo Director-Geral, após consulta aos Governos interessados, nas outras línguas que a Assembleia possa designar. (3) O Director-Geral enviará duas cópias, autenticadas pelo Governo da Suíça, do texto assinado do presente Acordo aos Governos dos países que o tenham assinado e, mediante pedido, ao Governo de qualquer outro país. (4) O Director-Geral registará o presente Acordo junto ao Secretariado das Nações Unidas. (5) O Director-Geral notificará os Governos de todos os países da União Especial sobre a data de entrada em vigor do Acordo, assinaturas, depósitos de instrumentos de ratificação ou adesão, aceitações de alterações a este Acordo e as datas em que tais alterações entram em vigor, bem como notificações de denúncia.

(4) (a) For the purpose of establishing its contribution referred to in paragraph (3)(i), each country of the Special Union shall belong to the same class as it belongs to in the Paris Union for the Protection of Industrial Property, and shall pay its annual contributions on the basis of the same number of units as is fixed for that class in that Union.

If the fund becomes insuf- ficient, the Assembly shall decide to increase it. (b) The amount of the initial payment of each country to the said fund or of its participation in the increase thereof shall be a proportion of the contribution of that country for the year in which the fund is established or the decision to in- crease it is made.

Article 8 Amendment of Articles 5 to 8 (1) Proposals for the amendment of Articles 5, 6, 7, and the present Article, may be initiated by any country of the Special Union or by the Director General. Such proposals shall be communicated by the Director General to the countries of the Special Union at least six months in advance of their con- sideration by the Assembly. (2) Amendments to the Articles referred to in para- graph (1) shall be adopted by the Assembly. (4) As decisões da Comissão de Peritos relativas à adopção de alterações e aditamentos a introduzir na classificação internacional serão tomadas por maioria simples dos países da União Particular. No entanto, se tais decisões implicarem a criação de uma nova classe ou qualquer transferência de produtos de uma classe para outra, será necessária a unanimidade.

Se, no termo desse prazo, o número de países que assim expressaram o seu voto ou abstenção atingir o número de países que faltava para atingir o quórum na própria sessão, essas decisões entrarão em vigor, desde que, ao mesmo tempo, a maioria exigida ainda seja obtida. (d) Sem prejuízo do disposto no n.º 2 do artigo 8.º, as decisões da Assembleia exigirão dois terços dos votos expressos. (e) As abstenções não serão consideradas votos. (f) Um delegado só pode representar e votar em nome de um único país. (4) A Assembleia reunir-se-á uma vez a cada dois anos civis em sessão ordinária, mediante convocação do Director-Geral e, salvo circunstâncias excepcionais, durante o mesmo período e no mesmo local da Assembleia Geral da Organização. (b) A Assembleia reunir-se-á em sessão extraordinária mediante convocação do Director-Geral, a pedido de um quarto dos países membros da Assembleia. (c) A ordem do dia de cada sessão será preparada pelo Director-Geral. (5) A Assembleia adoptará o seu próprio regulamento interno.

(3) (a) O Secretariado Internacional, de acordo com as orientações da Assembleia, fará os preparativos para as conferências de revisão das disposições do Acordo, com excepção dos artigos 5.º a 8.º. (b) O Secretariado Internacional poderá consultar organizações intergovernamentais e internacionais não governamentais sobre os preparativos para as conferências de revisão. (c) O Director-Geral e as pessoas por ele designadas participarão, sem direito a voto, nas discussões dessas conferências. (4) O Secretariado Internacional desempenhará quaisquer outras tarefas que lhe forem atribuídas.

(d) Um país que esteja em atraso no pagamento das suas contribuições não poderá exercer o seu direito de voto em qualquer órgão da União Especial se o montante dos seus atrasados for igual ou superior ao montante das contribuições devidas pelos dois anos completos anteriores. No entanto, qualquer órgão da União Especial pode permitir que tal país continue a exercer o seu direito de voto no referido órgão se, e enquanto, estiver convencido de que o atraso no pagamento se deve a circunstâncias excecionais e inevitáveis. (e) Se o orçamento não for aprovado antes do início de um novo exercício financeiro, será mantido ao mesmo nível do orçamento do ano anterior, conforme previsto nos regulamentos financeiros. (5) O valor das taxas e encargos devidos pelos serviços prestados pelo Secretariado Internacional em relação à União Especial será fixado e comunicado à Assembleia pelo Director-Geral. (6) (a) A União Especial será dotada de um fundo de capital de giro constituído por um pagamento único feito por cada país da União Especial. Se o fundo se tornar insuficiente, a Assembleia decidirá sobre o seu aumento. (b) O montante do pagamento inicial de cada país para o referido fundo ou da sua participação no aumento do mesmo será proporcional à contribuição do país para o ano em que o fundo for constituído ou em que for tomada a decisão de o aumentar. (c) A proporção e as condições de pagamento serão fixadas pela Assembleia, sob proposta do Director-Geral e após apreciação do parecer do Comité de Coordenação da Organização. (7) (a) No acordo de sede celebrado com o país em cujo território a Organização tem a sua sede, deve ser previsto que, sempre que o fundo de capital de giro seja insuficiente, esse país concederá adiantamentos. O montante desses adiantamentos e as condições em que são concedidos serão objecto de acordos separados, em cada caso, entre o referido país e a Organização. (b) O país referido na alínea (a) e a Organização terão, cada um, o direito de denunciar a obrigação de conceder adiantamentos, mediante notificação por escrito. A denúncia produzirá efeitos três anos após o final do ano em que tiver sido notificada. (8) A auditoria das contas será efetuada por um ou mais países da União Especial ou por auditores externos, conforme previsto no regulamento financeiro. Os auditores serão designados pela Assembleia, mediante o seu consentimento.
  248. Número ou marcador, página 35: Artigo 8.º Alteração dos artigos 5.º a 8.º
  249. Texto do artigo, página 35: (1) As propostas de alteração dos artigos 5.º, 6.º, 7.º e do presente artigo podem ser apresentadas por qualquer país da União Especial ou pelo Director-Geral. Tais propostas devem ser comunicadas pelo Director-Geral aos países da União Especial com pelo menos seis meses de antecedência em relação à sua apreciação pela Assembleia. (2) As alterações aos artigos referidos no parágrafo (1) serão adotadas pela Assembleia. A adopção exigirá três quartos dos votos expressos, desde que qualquer alteração ao artigo 5.º e ao presente parágrafo requeira quatro quintos dos votos expressos. (3) Qualquer alteração aos artigos referidos no n.º 1 entrará em vigor um mês após o Director-Geral ter recebido notificações escritas de aceitação, feitas em conformidade com os respetivos processos constitucionais, de três quartos dos países membros da União Especial no momento em que a alteração foi adotada. Qualquer alteração aos referidos artigos assim aceite vinculará todos os países que sejam membros da União Especial no momento em que a alteração entrar em vigor, ou que se tornem membros da mesma numa data posterior, desde que qualquer alteração que aumente as obrigações financeiras dos países da União Especial vincule apenas os países que tenham notificado a sua aceitação de tal alteração.
  250. Número ou marcador, página 35: Artigo 9.º Ratificação e Adesão; Entrada em Vigor
  251. Texto do artigo, página 35: (1) Qualquer país signatário da Convenção de Paris para a Proteção da Propriedade Industrial que tenha assinado o presente Acordo pode ratificá-lo e, caso não o tenha assinado, pode aderir ao mesmo. (2) Os instrumentos de ratificação e adesão serão depositados junto do Director-Geral. (3) (a) No que diz respeito aos primeiros cinco países que tiverem depositado os seus instrumentos de ratificação ou adesão, o presente Acordo entrará em vigor três meses após o depósito do quinto instrumento. (b) No que diz respeito a qualquer outro país, o presente Acordo entrará em vigor três meses após a data em que a sua ratificação ou adesão tiver sido notificada pelo DirectorGeral, salvo se tiver sido indicada uma data posterior no instrumento de ratificação ou adesão. Neste último caso, o presente Acordo entrará em vigor em relação a tal país na data indicada. (4) A ratificação ou adesão implicará automaticamente a aceitação de todas as cláusulas e a admissão a todas as vantagens do presente Acordo.

  255. Texto do artigo, página 36: (1) Os artigos 1.º a 4.º e 9.º a 15.º do presente Acordo podem ser submetidos a revisão com vista à introdução das melhorias desejadas. (2) Todas as revisões serão deliberadas numa conferência que será realizada entre os delegados dos países da União Especial.

  257. Texto do artigo, página 36: (1) Qualquer país pode denunciar o presente Acordo mediante notificação dirigida ao Director-Geral. Tal denúncia afetará apenas o país que a efetuar, permanecendo o Acordo em pleno vigor e efeito no que diz respeito aos outros países da União Especial. (2) A denúncia produzirá efeitos um ano após a data em que o Director-Geral tiver recebido a notificação. (3) O direito de denúncia previsto no presente Artigo não poderá ser exercido por nenhum país antes do termo de um prazo de cinco anos, a contar da data em que se tornou membro da União Especial.

  259. Texto do artigo, página 36: Para o presente Acordo, são aplicáveis os termos do artigo 24.º da Convenção de Paris para a Proteção da Propriedade Industrial.
  260. Número ou marcador, página 37: Artigo 14.º Assinatura, Línguas, Notificações (1) (a) O presente Acordo será assinado em um único exemplar nas línguas Inglesa e Francesa, sendo ambos os textos igualmente autênticos, e será depositado junto do Governo da Suíça. (b) O presente Acordo permanecerá aberto para assinatura em Berna até 30 de junho de 1969. (2) Os textos oficiais serão determinados pelo Director-Geral, após consulta aos Governos interessados, nas outras línguas que a Assembleia possa designar. (3) O Director-Geral enviará duas cópias, autenticadas pelo Governo da Suíça, do texto assinado do presente Acordo aos Governos dos países que o tenham assinado e, mediante pedido, ao Governo de qualquer outro país. (4) O Director-Geral registará o presente Acordo junto ao Secretariado das Nações Unidas. (5) O Director-Geral notificará os Governos de todos os países da União Especial sobre a data de entrada em vigor do Acordo, assinaturas, depósitos de instrumentos de ratificação ou adesão, aceitações de alterações a este Acordo e as datas em que tais alterações entram em vigor, bem como notificações de denúncia.
