Os Estados Partes comprometem-se a apresentar ao Comité, através do Secretário-Geral da Organização das Nações Unidas, relatórios sobre as medidas legislativas, judiciais, administrativas e de outra natureza que hajam adoptado para dar aplicação às disposições da presente Convenção:

Este Estado Parte pode submeter ao Comité observações sobre qualquer comentário feito pelo Comité ao abrigo do disposto no presente artigo. O Comité pode solicitar aos Estados Partes informações complementares.

Antes da abertura de cada sessão ordinária do Comité, o Secretário-Geral da Organização das Nações Unidas transmite, atempadamente, ao Director-Geral do Secretariado Internacional do Trabalho cópia dos relatórios apresentados pelos Estados Partes interessados e informações úteis à apreciação desses relatórios, de modo a possibilitar ao Secretariado prestar assistência ao Comité, através da disponibilização de conhecimentos especializados nas matérias abordadas na presente Convenção que se inscrevam no mandato da Organização Internacional do Trabalho. - Número ou marcador, página 13: 1. Qualquer Estado Parte na presente Convenção pode, em virtude do presente artigo, declarar, em qualquer momento, que reconhece a competência do Comité para receber e apreciar comunicações de um Estado Parte, invocando o não cumprimento por outro Estado das obrigações decorrentes da presente Convenção. As comunicações apresentadas ao abrigo do disposto neste artigo só podem ser recebidas e apreciadas se forem provenientes de um Estado que tenha feito uma declaração, reconhecendo a competência do Comité, no que lhe diz respeito. O Comité não recebe as comunicações apresentadas por um Estado que não tenha feito tal declaração. Às comunicações recebidas nos termos do presente artigo é aplicável o seguinte procedimento:
- Número ou marcador, página 13: a) Se um Estado Parte na presente Convenção considerar que outro Estado Parte não cumpre as obrigações impostas pela presente Convenção pode, por comunicação escrita, chamar a atenção desse Estado para tal incumprimento. O Estado Parte pode, também, levar esta questão ao conhecimento do Comité. Num prazo de três meses a contar da recepção da comunicação, o Estado destinatário dirige, por escrito, ao Estado que fez a comunicação uma explicação ou outras declarações destinadas a esclarecer o assunto e que devem incluir, na máxima medida possível e pertinente, indicação sobre as regras processuais e os meios de recurso já utilizados, pendentes ou disponíveis;
- Número ou marcador, página 13: b) Se, no prazo de seis meses a contar da data da recepção da comunicação inicial pelo Estado destinatário, a questão não tiver sido resolvida a contento de ambos
- Texto do artigo, página 14: os Estados Partes interessados, qualquer um destes tem o direito de a submeter a apreciação do Comité, dirigindo uma notificação ao Comité bem como ao outro Estado interessado;
- Número ou marcador, página 14: c) O Comité só examinará a questão depois de verificar que todas as vias de recurso internas disponíveis foram esgotadas, em conformidade com os princípios geralmente reconhecidos do Direito internacional. Tal não se aplicará quando o Comité entender que os procedimentos de recurso ultrapassam os prazos razoáveis;
- Número ou marcador, página 14: d) Sob reserva das disposições da alínea c) do presente número, o Comité coloca-se à disposição dos Estados Partes interessados a fim de obter a solução amigável do litígio, fundada no respeito das obrigações enunciadas na presente Convenção;
- Número ou marcador, página 14: e) O Comité reúne à porta fechada para examinar as comunicações recebidas nos termos do presente artigo;
- Número ou marcador, página 14: f) O Comité pode pedir aos Estados interessados, referidos na alínea b) do presente número, as informações que julgar pertinentes relativamente a qualquer questão submetida nos termos da alínea b) do presente número;
- Número ou marcador, página 14: g) Os Estados Partes interessados, referidos na alínea b) do presente número, têm o direito de fazer-se representar quando da apreciação da questão pelo Comité e de apresentar alegações orais e/ou escritas;
- Número ou marcador, página 14: h) O Comité apresenta um relatório, no prazo de doze meses

- Número ou marcador, página 14: b) do presente número, nos seguintes termos:
- Texto do artigo, página 14: (i) Se for alcançada uma solução nos termos da alínea d) do presente número, o Comité limita o seu relatório a uma exposição breve dos factos e da solução alcançada; (ii) Se não for alcançada uma solução nos termos da alínea d) do presente número, o Comité expõe, no seu relatório, os factos relevantes relativos ao objecto do diferendo entre os Estados Partes interessados. O texto das alegações escritas e o auto das alegações orais apresentadas pelos Estados Partes interessados são anexados ao relatório. O Comité pode também comunicar apenas aos Estados Partes interessados as opiniões que julgar pertinentes. O relatório é comunicado aos Estados Partes interessados.
- Número ou marcador, página 14: 2. As disposições do presente artigo entrarão em vigor quando dez Estados Partes na presente Convenção tiverem feito a declaração prevista no n.º 1 deste artigo. A declaração é depositada pelo Estado Parte junto do Secretário-Geral da Organização das Nações Unidas, que transmitirá uma cópia aos outros Estados Partes. A declaração pode ser retirada em qualquer momento por notificação dirigida ao Secretário-Geral. A retirada não prejudica a apreciação de qualquer questão que já tenha sido transmitida nos termos do presente artigo; nenhuma outra comunicação de um Estado Parte será recebida ao abrigo do presente artigo depois que o Secretário-Geral tiver recebido a notificação da retirada da declaração, a menos que o Estado Parte interessado haja formulado uma nova declaração.

- Número ou marcador, página 14: 1. Qualquer Estado Parte na presente Convenção pode, em qualquer momento, declarar, nos termos do presente artigo, que reconhece a competência do Comité para receber e examinar comunicações apresentadas por pessoas sujeitas à sua jurisdição ou em seu nome, invocando a violação por esse Estado Parte dos seus direitos individuais, estabelecidos pela presente Convenção. O Comité não recebe nenhuma comunicação relativa a um Estado Parte que não tiver feito essa declaração.
- Número ou marcador, página 14: 2. O Comité declara inadmissível uma comunicação apresentada nos termos do presente artigo que seja anónima ou julgada abusiva ou incompatível com as disposições da presente Convenção.
- Número ou marcador, página 14: 3. O Comité não examina nenhuma comunicação submetida por uma pessoa nos termos do presente artigo, sem se certificar de que:
- Número ou marcador, página 14: a) A mesma questão não foi já submetida a outra instância internacional de inquérito ou de decisão;
- Número ou marcador, página 14: b) O interessado esgotou os recursos internos disponíveis; tal não se aplica se, na opinião do Comité, os procedimentos de recurso ultrapassam os prazos razoáveis ou se e pouco provável que as vias de recurso satisfaçam efectivamente o interessado.
- Número ou marcador, página 14: 4. Sob reserva das disposições do n.º 2 do presente artigo, o Comité dá conhecimento das comunicações apresentadas nos termos deste artigo ao Estado Parte na presente Convenção que tiver feito uma declaração nos termos do n.º 1 e tiver, alegadamente, violado uma disposição da Convenção. No prazo de seis meses, o referido Estado submete por escrito ao Comité explicações ou declarações clarificando o assunto e indicando, se for caso disso, as medidas que haja tornado para ultrapassar a situação.
- Número ou marcador, página 14: 5. O Comité examina as comunicações recebidas nos termos do presente artigo, tendo em conta toda a informação fornecida pelo interessado ou em seu nome e pelo Estado posta em causa.

- Número ou marcador, página 14: 7. O Comité transmite as suas conclusões ao Estado Parte em causa e ao interessado.

- Texto do artigo, página 14: quando dez Estados Partes na presente Convenção tiverem feito a declaração prevista no n.º 1 do presente artigo. Tal declaração será depositada pelo Estado Parte junto do Secretário-Geral da Organização das Nações Unidas, que transmitirá cópia aos outros Estados Partes. A declaração pode ser retirada em qualquer momento por notificação dirigida ao Secretário-Geral. A retirada não obsta à apreciação de uma questão objecto de uma comunicação já apresentada nos termos do presente artigo. Nenhuma comunicação apresentada por um indivíduo, ou em seu nome, nos termos do presente artigo, será recebida depois da recepção pelo Secretário-Geral da notificação da retirada da declaração, a menos que o Estado Parte haja formulado uma nova declaração.

- Texto do artigo, página 14: As disposições do artigo 76 da presente Convenção aplicam-se sem prejuízo de qualquer processo de resolução de litígios ou de queixas no domínio coberto pela presente Convenção, previsto nos instrumentos constitutivos e convenções da Organização das Nações Unidas e das agências especializadas, e não impedem os Estados Partes de recorrerem a qualquer outro processo de resolução de litígios ao abrigo de acordos internacionais a que se encontrem vinculados.

- Texto do artigo, página 15: Os direitos dos trabalhadores migrantes e dos membros das suas famílias previstos na presente Convenção não podem ser objecto de renúncia. Não é permitido exercer qualquer forma de pressão sobre os trabalhadores migrantes e os membros das suas famílias para que renunciem a estes direitos ou se abstenham de os exercer. Não é possível a derrogação por contrato dos direitos reconhecidos na presente Convenção. Os Estados Partes tomam as medidas adequadas para garantir que estes princípios são respeitados.
- Número ou marcador, página 15: Artigo 83 Cada Estado Parte na presente Convenção compromete-se:
- Número ou marcador, página 15: a) A garantir que toda a pessoa cujos direitos e liberdades reconhecidos na presente Convenção tenham sido violados disponha de um recurso efectivo, ainda que a violação haja sido cometida por pessoas no exercício de funções oficiais;
- Número ou marcador, página 15: b) A garantir que, ao exercer tal recurso, o interessado possa ver a sua queixa apreciada e decidida por uma autoridade judiciária, administrativa ou legislativa competente, ou por qualquer outra autoridade competente prevista no sistema jurídico do Estado, e a desenvolver as possibilidades de recurso judicial;

Após o decurso de um período de cinco anos a contar da data da entrada em vigor da presente Convenção, qualquer Estado pode, em qualquer momento, propor a revisão da Convenção por via de notificação dirigida ao Secretário-Geral da Organização das Nações Unidas. O Secretário-Geral transmite, em seguida, a proposta de revisão aos Estados Partes, solicitando que lhe seja comunicado se são favoráveis a convocação de uma conferência de Estados Partes para apreciação e votação da proposta. Se, nos quatro meses subsequentes a essa comunicação, pelo menos um terço dos Estados Partes se declarar a favor da realização da referida conferência, o Secretário-Geral convocá-la-á sob

Se, no prazo de seis meses a contar da data do pedido de arbitragem, as Partes não chegarem a acordo sobre a organização da arbitragem, o diferendo pode ser submetido ao Tribunal Internacional de Justiça, em conformidade com o Estatuto do Tribunal, por iniciativa de qualquer das Partes.

Qualquer Estado Parte pode, no momento da assinatura ou do depósito do instrumento de ratificação ou de adesão da presente Convenção, declarar que não se considera vinculado pelas disposições do n.º 1 do presente artigo. Os outros Estados Partes não ficam vinculados pelas referidas disposições em relação ao Estado Parte que tiver formulado tal declaração.

- Texto do artigo, página 17: (d) The term “worker on an offshore installation” refers to a migrant worker employed on an offshore installation that is under the jurisdiction of a State of which he or she is not a national; (e) The term “itinerant worker” refers to a migrant worker who, having his or her habitual residence in one State, has to travel to another State or States for short periods, owing to the nature of his or her occupation; (f) The term “project-tied worker” refers to a migrant worker admitted to a State of employment for a defined period to work solely on a specific project being carried out in that State by his or her employer; (g) The term “specified-employment worker” refers to a migrant worker: (i) Who has been sent by his or her employer for a restricted and defined period of time to a State of employment to undertake a specific assignment or duty; or (ii) Who engages for a restricted and defined period of time in work that requires professional, commercial, technical or other highly specialized skill; or (iii) Who, upon the request of his or her employer in the State of employment, engages for a restricted and defined period of time in work whose nature is transitory or brief; and who is required to depart from the State of employment either at the expiration of his or her authorized period of stay, or earlier if he or she no longer undertakes that specific assignment or duty or engages in that work; (h) The term “self-employed worker” refers to a migrant worker who is engaged in a remunerated activity otherwise than under acontract of employment and who earns his or her living through this activity normally working alone or together with members of his or her family, and to any other migrant worker recognized as self-employed by applicable legislation of the State of employment or bilateral or multilateral agreements.

It shall not be the general rule that while awaiting trial they shall be detained in custody, but release may be subject to guarantees to appear for trial, at any ‘other stage of the judicial proceedings and, should the occasion arise, for the execution of the judgement.

When a migrant worker or a member of his or her family is arrested or committed to prison or custody pending trial or is detained in any other manner: (a) The consular or diplomatic authorities of his or her State of origin or of a State representing the interests of that State shall, if he or she so requests, be informed without delay of his or her arrest or detention and of the reasons therefor; (b) The person concerned shall have the right to communicate with the said authorities. Any communication by the person concerned to the said authorities shall be forwarded without delay, and he or she shall also have the right to receive communications sent by the said authorities without delay; (c) The person concerned shall be informed without delay of this right and of rights deriving from relevant treaties, if any, applicable between the States concerned, to correspond and to meet with representatives of the said authorities and to make arrangements with them for his or her legal representation.

Migrant workers and members of their families who are deprived of their liberty by arrest or detention shall be entitled to take proceedings before a court, in order that that court may decide without delay on the lawfulness of their detention and order their release if the detention is not lawful. When they attend such proceedings, they shall have the assistance, if necessary without cost to them, of an interpreter, if they cannot understand or speak the language used.

In the determination of any criminal charge against them, migrant workers and members of their families shall be entitled to the following minimum guarantees: (a) To be informed promptly and in detail in a language they understand of the nature and cause of the charge against them; (b) To have adequate time and facilities for the preparation of their defence and to communicate with counsel of their own choosing; (c) To be tried without undue delay; (d) To be tried in their presence and to defend themselves in person or through legal assistance of their own choosing; to be informed, if they do not have legal assistance, of this right; and to have legal assistance assigned to them, in any case where the interests of justice so require and without payment by them in any such case if they do not have sufficient means to pay; (e) To examine or have examined the witnesses against them and to obtain the attendance and examination of witnesses on their behalf under the same conditions as witnesses against them; (f) To have the free assistance of an interpreter if they cannot understand or speak the language used in court; (g) Not to be compelled to testify against themselves or to confess guilt.

Article 21 It shall be unlawful for anyone, other than a public official duly authorized by law, to confiscate, destroy or attempt to destroy identity documents, documents authorizing entry to or stay, residence or establishment in the national territory or work permits. No authorized confiscation of such documents shall take place without delivery of a detailed receipt. In no case shall it be permitted to destroy the passport or equivalent document of a migrant worker or a member of his or her family. Article 22
